With BeSpelled Partner Vendors and other Fulfillment Services: If your order includes an item shipped directly by a BeSpelled Partner Vendor or Fulfillment Service on our platform, we will share necessary information (such as your name, shipping address, and order details) solely for the purpose of fulfilling your order, and ensuring the item is shipped directly to you. c. With Shipping Carriers: We will necessary information (such as your name and shipping address) solely for the purpose of shipping your order. d. With law enforcement in response to valid requests by public authorities, to protect our rights, property, or safety, or the rights, property, or safety of our customers or others. e. BeSpelled Creative Guild Applicants and Contributors: If you apply to join our BeSpelled Creative Guild as a contributor, or if you are an active contributor, we collect specific business and personal information. a Data we collect: Examples of personal data we may collect include your name, email address, phone number, and address. We may also collect professional and business information, such as the name of your company, links to business or social media profiles, and other details provided through communications with us. If we purchase items from you, we will collect necessary financial information, such as payment account details, to process payments to you. How We Use This Information: We use the information provided to assess your suitability for contributing to the guild, to manage the purchasing relationship, to comply with legal obligations, for fraud prevention, and for record keeping. We use your financial information solely to process payments for the goods or services we purchase from you. How We Share This Information: Your information is shared internally with staff involved in evaluating applications, managing the contributor relationship, and processing payments. Your payment information will be shared with our third-party payment processors and financial institutions to facilitate payments to you. We may share information when required by law (e.g., in response to a court order). Data Retention: We retain application information for a reasonable period to consider your application and for our legitimate business interests, even if you are not selected. For active contributors, we retain your information for the duration of our purchasing relationship and for a period thereafter as required by law (e.g., for accounting records) or for dispute resolution.

Terms & Conditions

The sections below are the official BeSpelled by Fae Terms & Conditions (Terms, for short). The Terms are a legally binding contract between you and BeSpelled by Fae. By using the BeSpelled website, including via mobile, other services or by placing an order with BeSpelled by Fae, you agree to be bound by these terms.
1. No Refunds or Returns (General Policy): All sales are final. BeSpelled by Fae does not offer refunds or accept returns on any products once they have been shipped. We encourage you to carefully review product descriptions and images prior to placing your order. For questions regarding product failure or issues with shipping, please see Sections 4 and 6 for the process of obtaining a corrective action or resolution.
2. Order Cancellations: Orders may be cancelled for a full refund only if the cancellation request is received within twenty-four (24) hours of placement or before the order has shipped, whichever comes first. For cancellations requested more than twenty-four (24) hours after the order was originally placed, but before the order has shipped, a $5.00 restocking fee will be withheld from the refund amount. This fee helps cover processing and handling costs associated with the order.
3. Handmade Nature and Variations: Due to the nature of hand-crafted goods, slight variations in color, size, and appearance may occur. By placing an order for a handcrafted item, you acknowledge and accept that these variations are inherent to the handcrafted process and are not considered product defects under any circumstances. We strive to accurately represent our products through descriptions and images, but minor differences are to be expected.
4. Product Failure and Corrective Actions: For the purposes of this Section, a product failure is defined as a significant manufacturing error that renders the product unusable or substantially different from the product description. This does not include expected variations due to the handcrafted process (see Section 3), damage incurred during shipping (see Section 6), or after the item has been delivered. Responsibility for resolution depends on the product source: a. BeSpelled by Fae Branded and Fulfillment Partner Items: If the product is manufactured or branded directly by BeSpelled by Fae, or if it is sourced from a fulfillment partner, we will handle the issue directly. Please submit your claim using the dedicated Order Support Form referenced in Section 12. Resolutions will be determined by BeSpelled by Fae and may include a replacement or corrective action, at our sole discretion. Our general No Refund policy (Section 1) remains in effect. Creative Guild Artisan Items (Vendor-Supplied Items): If the product is sourced from a contributing artisan, all claims related to manufacturing, defect, or performance are subject to the liability provisions outlined in Section 11.
5. Product Information and Descriptions: We strive to provide accurate and up-to-date information for all products listed on the BeSpelled by Fae website. However, BeSpelled by Fae does not warrant that product descriptions, images, or other content are entirely accurate, complete, current, or error-free.
6. Shipping:Most BeSpelled by Fae items are shipped via USPS, though other major carriers may be used by partners. Tracking information will be provided for each order. BeSpelled by Fae is not responsible for the shipment once tracking information has been provided to the customer. This means the customer assumes all risk of loss for items lost, stolen, or damaged during transit. BeSpelled by Fae will not provide replacement shipments or refunds for issues caused by the carrier after shipping. Insurance Notice: For the customer's protection, all orders are shipped with carrier insurance. If a claim is necessary, the customer is responsible for initiating the process and providing all required documentation (photos, damage proof). BeSpelled by Fae will cooperate with the carrier's requirements to facilitate the insurance claim, but this cooperation does not constitute a liability for refund or replacement.
7. Payment Terms: We accept major credit and debit cards, digital wallets (including Apple Pay and Google Pay), PayPal, and Affirm. All payments are processed securely through Wix Payments and associated partners. Payment for all merchandise is due in full to BeSpelled by Fae at the time the order is placed. If payment is declined, your order will not be processed. All transactions are processed in United States Dollars (USD). Prices and applicable sales tax will be clearly calculated and displayed at checkout. Affirm Financing: If you choose to finance your purchase through Affirm, your agreement regarding repayment is subject to Affirm's separate terms, conditions, and payment schedules. BeSpelled by Fae is not responsible for the agreements or financing requirements set by Affirm.
8. Intellectual Property: The name BeSpelled by Fae, our logos, designs, and all original content created by us on this website (including our own text, images, and graphics) are the property of BeSpelled by Fae and are protected by copyright laws. Content related to products supplied and fulfilled by our third-party vendors (such as their product photos and descriptions) is owned by those respective vendors and is used by us with their permission. You may not use, copy, reproduce, or distribute any content from this website without our express written permission.
9. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.
10. Product Use and Safety Disclaimer : You acknowledge that all BeSpelled by Fae body and fragrance products are for external use only. Ingredients are listed in full on the product page and/or label. It is the customer's sole responsibility to review the ingredient list and perform a patch test before use. BeSpelled by Fae is not responsible for any personal injury, allergic reactions, adverse effects, or property damage resulting from the use or misuse of any product sold. By purchasing, you assume all risk and liability for the use of the products.
11. Limitation of Liability and Product Disclaimers: You expressly agree that BeSpelled by Fae shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use our products or website. In all cases, BeSpelled by Fae's total liability for any claim arising from an order shall not exceed the amount the customer paid for that specific product. Vendor-Supplied Items: As a curated retailer of goods from small businesses and other vendors, BeSpelled by Fae relies on our partners for the quality and safety of their products. If you have a claim related to the manufacturing, defect, or performance of a vendor-supplied item, we ask that you contact us first using the dedicated Order Support Form referenced in Section 12. We will then work with you to connect you with the appropriate vendor to pursue a resolution.
